Terms for SurfBerichtje
These terms describe the service in plain language. Mandatory consumer rights always remain unaffected.
1. The service
SurfBerichtje evaluates when surf conditions are good at your selected Dutch surf spot. It provides forecasts, weekly outlooks and alerts through Telegram and, for the relevant plan after a separate opt-in, WhatsApp. The information is an aid, not a live observation or personal safety advice.
2. Channels and access
You need a working Telegram account. For WhatsApp you separately provide your telephone number and explicit consent after payment. STOP pauses WhatsApp delivery only and does not cancel the paid subscription. Do not share an activation link or other personal access with third parties.
3. Spot and messages
You select one supported spot and can change it in Telegram. Every subscriber receives the same product: the Sunday weekly outlook, surf alerts, one final confirmation per normal alert, and short-notice alerts where relevant. You can pause and resume automatic messages; requested commands remain available while paused.
4. Forecasts and safety
Weather and surf models can change or differ from conditions at the coast. SurfBerichtje does not guarantee wave height, surf quality, an available surf window or safe conditions. You decide whether to go, check current local conditions, account for currents, obstacles, weather and your own ability, and follow instructions from competent authorities.
5. Price and automatic renewal
The consumer price is €25 per year for Telegram or €35 per year for Telegram + WhatsApp, including applicable VAT. The initial paid period is a fixed 12-month period beginning when payment is confirmed. The selected plan then renews automatically each year for the same annual amount until you cancel.
6. Cancellation
You may cancel during the initial 12 months; cancellation then takes effect at the end of that fixed period and access continues until that date. After the initial fixed period, cancellation is immediate. Further payments stop and unused prepaid time in a renewal year is refunded pro rata by calendar day, never above the amount actually received. 7. Cooling-off and withdrawal
An online service generally comes with a statutory 14-day cooling-off period from the moment the agreement is concluded and confirmed. You may withdraw within that period without giving a reason, through Withdraw purchase or, where legally applicable, by any other unambiguous statement to SurfBerichtje through the contact page.
SurfBerichtje starts immediately after payment only because you expressly request this while ordering. Starting immediately does not by itself remove your statutory cooling-off rights. Under its own customer-friendly policy SurfBerichtje refunds the full initial amount paid for a valid withdrawal within that period, with nothing deducted for the days you already used the service.
8. Express request to start immediately
While ordering you tick one statement yourself: “I agree to the terms and request SurfBerichtje to start immediately after payment.” By ticking it you expressly ask SurfBerichtje to provide the service as soon as your payment succeeds, therefore already during the cooling-off period. The box is never pre-ticked and the order cannot be placed without it. Accepting these terms on its own is not that request: the request is the ticked statement at checkout. SurfBerichtje stores that statement with your order and repeats it in the confirmation email.
9. Payment, refunds and failed renewal
Payments and refunds are processed through Mollie; SurfBerichtje does not store complete bank or card details. The first payment establishes a continuing mandate so the annual renewal can be collected automatically; that mandate ends on cancellation or withdrawal. A refund is financially complete only when the payment provider confirms it. If an annual payment fails, paid access can remain active for a recovery period of up to seven days and recovery instructions are emailed. Without recovery only paid access ends; manually granted complimentary access remains unaffected.
10. Availability
SurfBerichtje aims to provide a reliable service, but internet, Telegram, data-source or server incidents and maintenance can delay messages or make them temporarily unavailable. A missing or delayed alert does not indicate that the sea is safe or unsuitable.
11. Reasonable use
Use the bot personally and normally. Do not bypass security or access controls, disrupt the service or use responses to mislead others. Access may be restricted or ended for abuse, a security risk or non-payment, without affecting statutory rights.
12. Changes
SurfBerichtje may adjust features, supported spots and these terms. A change that materially disadvantages a running paid subscription must be communicated clearly and may not restrict statutory cancellation or termination rights.
13. Privacy, questions and complaints
The privacy notice describes data processing. Questions and complaints can be submitted through the contact page. These terms are not presented as excluding rights that cannot be excluded under applicable mandatory law.
